Welcome to FortuneInk. These Terms of Service (“Terms”) govern your access to and use of the FortuneInk website, products, and print-on-demand fulfillment services. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, you may not use our services.

1. General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (excluding credit card information), may be transferred unencrypted and involve transmissions over various networks. Credit card information is always encrypted during transfer over networks.

2. Intellectual Property and Content Policy

FortuneInk is a print-on-demand company. We print the designs, images, and text that you submit to us.

  • Ownership: You retain all ownership rights and copyright to the original designs and content you upload to our platform. FortuneInk does not claim any ownership rights over your intellectual property.
  • Your Responsibility: By uploading a design or placing an order, you represent and warrant that you own the rights to the content or have obtained all necessary commercial licenses, trademarks, and permissions to reproduce the design.
  • Content Restrictions: You agree not to upload any content that is illegal, defamatory, obscene, promotes violence or hate speech, or infringes on the intellectual property rights of any third party.
  • Right to Refuse: FortuneInk reserves the right, at our sole discretion, to reject and cancel any order that we determine violates this Content Policy or is otherwise inappropriate for our production facilities.

3. Products and Pricing

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We have made every effort to display as accurately as possible the colors and images of our products that appear on the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

4. Orders and Production

  • Custom Manufacturing: All FortuneInk products are made-to-order. Production begins only after an order is successfully placed and paid for.
  • Production Times: We strive to fulfill orders as quickly as possible. However, the production times listed on our website are estimated averages, not guarantees. Delays may occur during peak holiday seasons or due to unforeseen supply chain disruptions.
  • Order Modifications: Because our system is automated to ensure fast production, we can only accept order modifications or cancellations within 2 hours of the order being placed. After this window, the order goes into production and cannot be changed.

5. Returns, Refunds, and Replacements

Due to the custom nature of our print-on-demand business, we do not hold inventory. Every item is printed specifically for you.

  • No Buyer’s Remorse: We do not offer returns, refunds, or exchanges for “buyer’s remorse,” incorrect color selection, or incorrect size selection. Please refer to our sizing charts carefully before ordering.
  • Damaged or Defective Items: We stand behind the quality of our printing. If an item arrives misprinted, damaged, or defective, please contact us within 14 days of receiving your order. You must provide clear photographs showing the defect. Upon verification, FortuneInk will issue a free replacement or a full refund at our discretion.
  • Lost in Transit: For packages lost in transit, all claims must be submitted no later than 30 days after the estimated delivery date.

6. Shipping and Delivery

FortuneInk utilizes third-party shipping carriers to deliver your orders. The risk of loss and title for items purchased from us pass to you upon our delivery of the items to the carrier. We are not responsible for delays, lost packages, or misdeliveries caused by the carrier, customs clearance processes, or incorrect shipping addresses provided by you at checkout.

7. Prohibited Uses

In addition to other prohibitions as set forth in the Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service.

8. Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. To the fullest extent permitted by applicable US law, in no case shall FortuneInk, our directors, officers, employees, affiliates, agents, contractors, or suppliers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

9. Indemnification

You agree to indemnify, defend and hold harmless FortuneInk and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party (including, but not limited to, copyright or trademark infringement claims related to the designs you submit).

10. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States.
